Facing Deportation in West Virginia? What You Need to Know About Cancellation of Removal and Bond Hearings

If you or a loved one in West Virginia has received a Notice to Appear in Immigration Court, you’re likely feeling overwhelmed. While there is no immigration court located within West Virginia, residents are still placed in removal proceedings and required to appear at courts in neighboring states. Whether your hearing is scheduled in Pittsburgh, PA, Cleveland, OH, Charlotte, NC, or one of the Virginia courts in Annandale, Falls Church, Richmond, or Sterling, you still have rights—and you may qualify for Cancellation of Removal to stop deportation.

At Kvisaxpress Immigration Law Firm, based in Charleston, WV, we help West Virginia families build strong defenses against deportation and fight for release from detention through bond hearings.

What Is Cancellation of Removal?

Cancellation of Removal is a powerful immigration defense for people already in removal proceedings. If approved, it can stop your deportation and even provide lawful status in the U.S.

There are two main types:

1. Cancellation for Lawful Permanent Residents (LPRs)

You may qualify if you:

  • Have had a green card for at least 5 years
  • Have lived in the U.S. for 7 continuous years after being admitted
  • Have not been convicted of an aggravated felony
  • Deserve a favorable exercise of discretion by the judge

2. Cancellation for Non-LPRs (Undocumented or Out-of-Status Individuals)

You may qualify if you:

  • Have lived in the U.S. for 10 years or more
  • Can show good moral character
  • Have a U.S. citizen or lawful permanent resident spouse, parent, or child who would face exceptional and extremely unusual hardship if you were deported
  • Can prove you deserve relief in the judge’s discretion

Where Do West Virginia Residents Attend Immigration Court?

Although there is no EOIR (Executive Office for Immigration Review) immigration court in West Virginia, residents are typically scheduled for hearings at nearby locations, including:

  • Pittsburgh, PA
  • Cleveland, OH
  • Charlotte, NC
  • Annandale, Falls Church, Richmond, or Sterling, VA

We assist clients with preparing for these hearings, whether they are in person or conducted via video teleconference (VTC).

Applying for Cancellation of Removal

To apply, you must be actively in removal proceedings. You’ll submit:

  • Form EOIR-42A (for LPRs)
  • Form EOIR-42B (for non-LPRs)

You’ll also need to provide strong documentation, such as:

  • Proof of residence and employment
  • Tax returns and community ties
  • Medical records and psychological evaluations (especially for hardship claims)
  • Birth certificates of qualifying relatives
  • Letters of support and good conduct

All filings go directly to the immigration court assigned to your case—not USCIS—and a judge will evaluate both the legal eligibility and your personal story.

Bond Hearings for Detained Immigrants

If your loved one is detained by ICE, they may be eligible for a bond hearing before an Immigration Judge. At Kvisaxpress, we prepare compelling bond motions and packages that show:

  • Stable community ties
  • Employment and residence
  • No risk to public safety
  • Low flight risk

Winning bond allows you or your loved one to fight the immigration case while living freely at home—not from a detention center.
